  1. Application and Definitions

1.1          This e-mail legal notice (“Notice”) is published in terms of the Electronic Communications and Transactions Act 25 of 2002 (“ECT”) and is enforceable and binding on the recipient of this email which was sent from Lake International Technologies (Pty) Ltd.

1.2          “Lake International Technologies (Pty) Ltd” means Lake International Technologies (Pty) Ltd (Proprietary) Limited, a company registered according to the laws of the Republic of South Africa under Registration Number 1946/023685/07 its affiliates and its subsidiaries.

 

  1. Confidentiality

2.1          The information contained in this e-mail is confidential and may be subject to legal privilege. No person, other than the recipient indicated by the sender may use and no person including the recipient may disclose the contents of the e-mail, links or attachments to any person whatsoever without [Lake International Technologies (Pty) Ltd ‘s prior written consent.

2.2          Unauthorised disclosure and/or use of the contents of the e-mail, links or attachments may result in civil and criminal liability.

2.3          The information in this e-mail is intended for the attention and use of the recipient only – if you are not the intended recipient, you are hereby notified that any disclosure, copying or distribution of the contents of this e-mail or the taking of any action in reliance thereof or pursuant thereto, is strictly prohibited. Should you have received this e-mail in error, please notify the sender and please delete and destroy it immediately.

3.1          Under no circumstances shall Lake International Technologies (Pty) Ltd or the sender of this e-mail be liable to any party for any direct, indirect, special or consequential damages, even if Lake International Technologies (Pty) Ltd and / or the sender of the e-mail have been expressly advised of the possibility of such damages.

3.2          Any agreements concluded with Lake International Technologies (Pty) Ltd by using electronic correspondence shall only come into effect once Lake International Technologies (Pty) Ltd has confirmed the conclusion of such agreements in a follow up or return communication, and always subject to the requirements of the ECT Act and contract law in general.

3.3          No e-mail sent to Lake International Technologies (Pty) Ltd shall be deemed to have been received until Lake International Technologies (Pty) Ltd has responded thereto. An auto-reply shall not constitute a response for the purposes of this clause. Return e-mail messages blocked by Lake International Technologies (Pty) Ltd virus detection and / or filtering applications shall not be deemed to have been received by Lake International Technologies (Pty) Ltd or the recipient.

3.4          No warranties are made or implied that the sender is or was authorised by Lake International Technologies (Pty) Ltd to create and send this e-mail. All reasonable precautions have been taken to ensure no viruses are present in the email and the sender cannot accept responsibility for loss or damage arising from the use of the email or its attachments.

4.1          All copyright, registered or unregistered trademarks or other intellectual property rights in this email or its attachments are the property of Lake International Technologies (Pty) Ltd and all rights therein are reserved.

4.2          The recipient is hereby licensed only to open and read this e-mail – all other rights are reserved unless so indicated by Lake International Technologies (Pty) Ltd.

4.23        Lake International Technologies (Pty) Ltd will take legal steps against any unauthorised use.

 

  1. Privacy Policy

5.1          The e-mail address of the sender may not be used, copied, sold, disclosed, shared, or incorporated into any database or mailing list for spamming and/or other online marketing practices without the prior consent of Lake International Technologies (Pty) Ltd.

5.2          Lake International Technologies (Pty) Ltd reserves the right to intercept, filter, view, block, delete, access, copy, read and act upon this e-mail and all e-mail messages sent as reply messages to this e-mail or to the address of the sender.

 

  1. Disputes

Subject to urgent and interim relief, all disputes and/or disagreements and/or damages and/or liabilities, in any manner related to the:

6.1          Interpretation, validity, access to and enforceability of this e-mail legal notice;

6.2          Content (including message headers, links and/or attachments) of this e-mail;

6.3          The time and place this e-mail was sent and/or delivered; and/or

6.4          The identity of the sender,

 

shall be referred to urgent and confidential arbitration in terms of the arbitration rules of the Arbitration Foundation of Southern Africa (“AFSA”).

 

  1. Governing Law

The law of South Africa shall govern this e-mail and disclaimer.
